WORKERS’ COMPENSATION LAW CHANGE – CORRECTIONAL OFFICERS:

The Maryland legislature passed a law this year that as of October 1, 2018 a Correctional Officer employed by the State of Maryland, Prince George’s County, Montgomery County and Anne Arundel County injured on the job will be entitled to a larger monetary award for minor or what is called “first tier” injuries. This enchanced benefit has been the law in Maryland for years but only applied to sworn Police Officers and Firefighters.

This change is significant for Correctional Officers that are covered under the change in the law as their recovery for any permanent impairment sustained as a result of a workplace injury could double. For example a Correctional Officer injured on September 30, 2018 and found to a have a 10% permanent impairment to his back would receive an award of $9,150.00. With the change in the law, a Correctional Officer injured on October 1, 2018 and found to have a 10% permanent impairment to his back would receive an award of $18,250.00.
